Terms & Conditions

The following Terms & Conditions apply to orders placed on this website and via telephone to our online sales department on 01773 714816. They don’t affect your statutory rights and by continuing to use this website you agree to be bound by these terms & conditions. Sofa Savvy Ltd reserves the right to amend or alter these conditions at any time.

Definitions:

“Conditions” means the terms & conditions set out in this document.

“Buyer” “Customer” You means the person who buys or agrees to buy products from the seller.

“Seller” means Sofa Savvy Ltd (Registered in England and Wales, company No 10145008)  located at Unit 1 Bradgate House, Derby Road, Derbyshire, DE75 7QL.

“Bespoke” these are goods that are made to order especially for the buyer in configuration, type or finish and will be clearly stipulated as made to order / bespoke on the website.

“Diminished value” means the amount of value loss of any item due to a change in the condition, age or demand associated with the item. This includes the packaging.

“Product(s)” means the Item(s), which are available for purchase, and described, on our Website;

“Working Day” means any week day excluding public holidays; and weekends.

“Writing” or “Written” in these terms, includes email(s).

1: Payments & Orders

1.1 Depending on the particular product(s) ordered, you may pay in full, or request to pay using interest free credit. Your chosen payment type will be charged when you submit your order whether you are paying in full or have only chosen to pay by finance application (if you have chosen this method of payment and to pay a deposit). Taking payment from you does not mean we have accepted your Order and if we are unable to accept your order, we will refund any payment made. Full payment of the balance is to be made prior to receipt of whole or part of the goods. No company or personal cheques accepted.

1.2 Paying In Full: Our online transactions are authenticated by Visa (for Visa Cards), MasterCard Secure Code(TM) (for MasterCard and Maestro cards) or American Express Safe key (for American Express cards) to give you extra peace of mind.

1.3 Pay Via Finance: We're excited to announce we have partnered with Snap Finance  to bring you new ways to pay at the checkout. Pay in 12 interest-free installments. Shop today and spread the cost of your purchase into 3 interest-free installments. The first payment is made at point of purchase, with remaining installments scheduled automatically every 30 days. Select the Snap Finance option at checkout and enter your debit or credit card information.


1.4 Once you have placed your order with us, we will send you an order confirmation email with the products itemised including any additional services pertaining to the order. In the event of order changes, there may be changes to delivery timescales and or the price for the items. If you do not receive an order confirmation, please contact us immediately as email and SMS is used to keep you appraised of the progress of your order.

1.5 You will be informed of the likely approximate length of time until delivery at the point of order. All lead times quoted on our website are provided for indicative purposes, being based on typical service levels from the manufacturer or supplier, The Product(s) availability times we quote are estimates only, not guarantees. We use our best endeavors to quote accurate lead times however for reasons outside of our control, occasionally expected lead times are longer. Sofa Savvy Ltd cannot be held responsible for any direct or indirect loss due to any reasonable delay or delays due to unforeseen circumstances outside of our reasonable control. We will inform you if expected lead times have extended beyond the dates quoted.

1.6 Bespoke - Made To Order Items: These are goods that have been ordered to the unique and exact specifications of a customer. We require a minimum 50% non-refundable deposit of the total invoice value of “bespoke” orders. A minimum period of 12 weeks is normally needed for “bespoke/made to order items”.

1.7 We try to ensure that the prices stated on our website are accurate and up to date. If we notice an error in the quoted price of the Product(s) you have ordered, then we will inform you as soon as possible and offer you the option of reconfirming your order at the correct price, or withdrawing your order. However, if we are unable to contact you or if we do not receive a response from you within 7 days then we will treat the order as withdrawn and you will receive a full refund of any payment you have made.

1.8 Sofa Savvy Ltd will have the right to refuse, cancel, modify, or take any action it may consider appropriate to address the error for any inquiry, quotation, purchase order or orders placed for products listed at the incorrect price, regardless of whether an order confirmation has been sent or not, and/or any payment has been made or not. If one or more payments have already been made and your order is confirmed, accepted, refused, cancelled, or modified in such a case of incorrect price, Sofa Savvy Ltd will refund any payment or payments you have already made for such item or items. Such a purchase order or orders will not be considered confirmed, and the item or items will not be shipped due to the non-validity of the purchase order or orders.

2: Cancellation, Returns & Refunds

2.1 Under the Consumer Contracts Regulations 2014 the Buyer has a statutory cooling off period and the right to cancel an order and receive a full refund for any item or service bought at distance. Under UK law, the statutory cooling off period has certain exclusions: See section 2.7

2.2 We want you to be happy with your purchase, however if the you are dissatisfied with a purchase for any reason and wish to return an Item(s), you may do so within fourteen days of delivery by written notification. Notifications must be within this period and in writing or no return will be possible.

2.3 If the Item(s) are returned for any other reasons other than being "defective" then you will be required to arrange and pay for the cost of returning the product(s) to us. Alternatively, we Sofa Savvy Ltd can arrange a collection for you and charge you the direct cost of collection. Collection charges are applied on a case-by-case basis depending on the nature of the product(s) and location it is collected from. Long distance delivery refunds may incur an additional return surcharge at the seller's discretion, based on the actual cost of returning the products(s). All collection charges will reflect our direct costs of collection and will be agreed with the customer in advance.

2.4 Buyers should retain all the original packaging upon receipt of any delivery bought at distance as this may be required in the unlikely event of a return. The product(s) that you wish to return must be returned in a fully re-saleable as new condition and in the original, unmarked and undamaged packaging (including all labels and tags intact). Please be aware it is your responsibility to check that the packaging is not damaged. We ask that upon delivery you fully Inspect your Item(s) prior to letting the courier leave and do not accept/sign for the Item(s) unless you are 100% satisfied. Examine your order for transportation damage. Damaged packaging may indicate that the product is also damaged. Once you have signed for the Item(s) you will be liable for any damage.

2.5 Please be advised that you do have a duty of care for the products during the period of cancellation and return / collection of the goods. We Sofa Savvy Ltd are unable to accept responsibility for items lost or damaged in transit back to us and retain the right to refuse a refund on any item deemed to be unsaleable. We Sofa Savvy Ltd retain the right to refuse returns if the item packaging is not retained and / or it's unsafe for our couriers to collect the item and bring it back to our warehouse.

2.6 Refunds will only take place after the goods have been returned, inspected, and deemed to be in a suitable / resaleable condition by our returns department. We will issue you an exchange or refund, as long as your returned product/s meet our conditions. Any monies paid will be refunded by the method you used to pay us. It can take up to 21 days (usually sooner) for the refund to appear in your bank account. Sofa Savvy Ltd will not be obliged to offer any compensation for disappointment suffered. This does not affect your statutory rights.

2.7 Excluded Items Information

*Bespoke / Made To Order items: Cancellations will not be accepted on any Bespoke / made to order items.These are goods that have been ordered to the unique and exact specifications of a customer. All bespoke / Made To Order Items are clearly marked as such In the product description/s. All bespoke orders are excluded from the Consumer Rights Act. Deposits & or full balances paid for “bespoke” orders are subject to a minimum cancellation charge amounting to 50% of the purchase price. Cancellations where manufacturing has commenced and/or purchases have been made on your behalf, include a cancellation charge up to the entire purchase price.The Buyer will not have any right to return any of the following Goods: ALL bespoke made to order items, items in a special finish, items in customer’s own fabric or design.

*Mattresses: No returns will be accepted on mattresses that have been unsealed and will be deemed as having been used. This policy Is due to hygiene reasons. If a mattress is faulty or damaged, we will only be able to offer a replacement or repair.

*Flat Pack Furniture: No returns will be accepted on flat pack items on which assembly has been attempted (this includes damaged items).If you have attempted assembly yourself or appointed any third party to assemble and whilst assembly damage the item, we are not liable for the damage and unable to offer return or refund. We request you to fully check the item/s before you start to assemble.

4: Delivery

4.1 We use Independent, furniture delivery carriers and other major delivery companies to deliver your product(s). If your product(s) are sent on a pallet, then the couriers will deliver to curb side.

4.2 The customer agrees that the name, phone number, email address and other contact information can be given by Sofa Savvy Ltd to the driver or any other courier / shipping agent to coordinate your delivery and improve customer satisfaction. All deliveries require a signature by an adult over the age of 18. Sofa Savvy Ltd will not be liable for any loss, damage, injury or any other casualty incurred at the time of delivery, under any circumstance.

4.3 We ask that at delivery you fully Inspect your Item(s) prior to letting the courier leave and do not accept/sign for the Item(s) unless you are 100% satisfied. Examine your order for transportation damage. Damaged packaging may indicate that the product is also damaged. Once you have signed for the Item(s) you will be liable for any damage. Sofa Savvy Ltd is not responsible for the goods once they have changed hands.

4.4 The Buyer shall have full responsibility for ensuring that there is suitable delivery access for all Item(s) that are ordered. You agree to be available to receive the product from the carrier at the time of delivery, and represent that the delivery address provided by you is accessible to trucking and delivery companies. Please ensure that measurements allow for easy delivery through doorways, passageways, stairways or any other way as you deem fit, and will fit into the living space of your choice. Sofa Savvy Ltd accepts no responsibility for failure to deliver any item due to restricted access.

4.5 Failed Deliveries: You agree to be available to receive the product/s from the carrier at the time/day of delivery, where a delivery date has been agreed with our carrier, but the customer isn’t present to receive the delivery, or we fail to receive a signature, we Sofa Savvy Ltd reserve the right to charge the customer a minimum of £50.00 up to the full delivery cost of the failed delivery. If the buyer requests that delivery be postponed or refuses to accept delivery or fails to give Sofa Savvy Ltd adequate delivery instructions, then the risk of damage to or loss of the product/s will pass to the buyer. At our discretion, Sofa Savvy Ltd may store the goods until a delivery date is agreed and charge the buyer for all related costs including insurance for storage. If you fail to arrange a delivery time with us, within a reasonable time frame, the goods will be deemed to have been delivered and become the property Sofa Savvy Ltd. Sofa Savvy Ltd may then sell the goods at the best price readily obtainable. Storage fees charged will not be refunded and any unpaid storage fees will be deducted from the amount of any refund. We Sofa Savvy Ltd will not be responsible for any loss or damage that may occur due to any unforeseen situations which are beyond our control, such as severe weather conditions, courier breakdown or traffic.

5: Item Specifics & Pricing

5.1 Reproduction of colours is as accurate as possible, but please note colours in store may vary slightly from what is displayed on your monitor or in any printed material. As variations may occur between batches, the colour of leather or fabric samples you have received from Sofa Savvy Ltd may vary slightly from colour of final product. It is your responsibility to ensure you are satisfied with the fabric / leather / colour option you select prior to placing your order.

5.2 Made To Order - Bespoke specifications, You are solely responsible for your final selection including the suitability of a particular covering, colour and model. Please choose carefully as we do not refund or exchange if you change your mind or make any error on your order.

5.3 While we strive towards our goal of a 100% error-free service, such mistakes can happen and we cannot guarantee that any or all content is accurate or complete, including price information, product specifications, lead time, or any other attribute listed. In no event shall Sofa Savvy Ltd be liable to provide the product/s to the customer at the inaccurate price. If we discover such errors, they will be corrected on our system using the best efforts on the part of Sofa Savvy Ltd.

6: Defects

6.1 Any claim by the Buyer based on a defect in the quality or condition of the goods must be notified to Sofa Savvy Ltd by the Buyer in writing within accordance of section 4, 4.3 of these terms & conditions.

6.2 Where the Buyer complies with Conditions 4.3 & 6.1, If a fault or damage is discovered, you must give us an opportunity to inspect and repair the product/s first, we will endeavour to repair the defective goods free of charge. If a repair is not possible you will be offered a replacement and only if a suitable replacement is not available will you be offered a refund. Please remember that if you’ve requested delivery outside the UK, then we can’t be held responsible for any damage that occurs during third-party shipping.

 

Miscellaneous provisions:

The contract between us shall be governed by the laws of England and any dispute between us will be resolved exclusively in the courts of England. English is the only language offered for the conclusion of the contract. Our products are chosen on the basis that they will be used for domestic use. If you are planning to use them for business purposes, please make sure that you are covered by the appropriate insurance. Where you decide to use the products in the course of a business, we exclude (to the fullest extent permitted by law) those warranties and conditions relating to fitness for a particular purpose. Our maximum liability to business users arising out of or in connection with the products shall be limited to the replacement value of the product in question (except in the case of death or personal injury caused by our negligence or in respect of fraud). In relation to business users, we do not accept liability for the fitness of goods for business purposes, nor do we accept liability for loss of use of the item nor any loss over and above the cost of the item in the event of a claim for breach of warranty or condition. All our sofas are suitable for general domestic use only. For commercial use, we do not accept any responsibility or liability for safety standards or compliance unless you have requested, in writing, furniture for use in that environment and we have supplied relevant safety certification. In no event will sofa savvy Ltd or our suppliers be liable for special, incidental, consequential or exemplary damages arising out of this agreement or out of the use of the site or for services provided by Sofa Savvy Ltd, Including, without limitation, damages or costs relating to the loss of profits, business, goodwill, data, computer programs, loss of information or programs or other data on your information handling system, that arise out of or otherwise are related to the use of, or the inability to use the content or the site or any linked website, the statements of any third party on the site, or unauthorised access to the site, your transmissions, your account or your password, even if we are advised of the possibility of such damages, or for any similar claim against you by another party. The above exclusion of incidental and consequential damages may not be enforceable under some applicable laws, so such may not apply to you. In no case shall Sofa Savvy Ltd except liability for money damages exceeding the Sofa Savvy invoice amount paid by you for the product. Sofa Savvy Ltd (and its third-party delivery providers) shall be under no liability for any delay or failure to deliver products or otherwise perform any obligation as specified in these terms and conditions if the same is wholly or partly caused whether directly or indirectly by circumstances beyond its reasonable control. Sofa Savvy Ltd Reserve the right to modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; We reserve the right to change these terms and conditions from time to time without notice to you and any changes will take effect on the day they are posted. Your continued use of the website constitutes your agreement to be bound by the prevailing terms and conditions. You will be requested to read and accept these terms and conditions every time you place an order. For this reason, we encourage you to review them whenever you use this website to ensure that you are familiar with the latest terms and conditions. We also recommend to all our customers to print and retain a copy of the terms and conditions for future reference. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions, then you must immediately stop using the Website.
